PickKado is operated by Makeza Limited. References to “PickKado”, “we”, “our”, or “us” mean Makeza Limited.

1. Acceptance of Terms

By accessing and using Pickkado ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our Service.

2. Description of Service

Pickkado provides a gift polling platform that allows users ("Givers") to create polls with multiple gift options and share them with recipients for anonymous selection. Our Service includes:

• Creation and management of gift polls
• Anonymous voting system for recipients
• Email notifications (free)
• SMS and WhatsApp notifications (premium, paid service)
• Thank you note functionality

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Payment Terms

Premium features (SMS and WhatsApp notifications) require payment:

• SMS delivery: $2.99 per poll
• WhatsApp delivery: $3.99 per poll
• Payments are processed securely through Paddle
• All fees are non-refundable unless required by law
• Prices are subject to change with 30 days notice

5. User Conduct

You agree not to use the Service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit spam, unsolicited messages, or harassment
• Upload malicious code or viruses
• Attempt to gain unauthorized access to our systems
• Use the Service for fraudulent purposes
• Impersonate any person or entity

6. Recipient Privacy

We are committed to maintaining recipient anonymity. Recipients' selections are only revealed to the Giver who created the poll. We do not share recipient choices with third parties or other recipients.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Pickkado and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

9. Limitation of Liability

In no event shall Pickkado, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of your access to or use of the Service.

10. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Pickkado operates, without regard to its conflict of law provisions.
